Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: On or about April 28, 2016, at the job site employees were observed climbing and standing on the guardrails of a scissor lift, approximately 14 feet high. This exposed the employee to the hazard of falling.

29 CFR 1926.352(d): Fire extinguishing equipment available in work area(s), where welding, cutting, or heating was being performed, was not maintained in a state of readiness for instant use: On or about April 28, 2016, at the job site employees were performing welding operation from a scissor lift where fire extinguishers were not provided on the lift for immediate use. Employees could be exposed to fire hazard.
