OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish the employees employment and a place of employment which were free from hazards that were causing or likely to cause death or serious physical harm to employees in that the lack of use of a seat belt can result in the forklift rolling on the operator, the operator is thrown out or fall out; therefore the employees were exposed to crushing by/struck by hazards:    a) Fairfield Pallet Co. Inc. - 282 Rockville Road, Bridgeton NJ 08302:  On or about April 19, 2016, the employer failed to ensure employees were protected from hazards associated with falls while driving forklifts without wearing an operator restraint system.      Abatement method:  Instruct the Forklift drivers about the safety instructions included in the Diesel Doosan Forklift model # D25S-5 Operators Manual  page 2, which states "The DOOSAN operator restraint system can minimize injuries.  The DOOSAN operator restraint system keeps the operator substantially within the confines of the operator's compartment and overhead guard". In addition, the Diesel Doosan Forklift model # D25S-5 Operators Manual, page 19 states  " The Operator Restrain System, Prevents the operator from jumping from the operator's compartment in the event of a forward or side tip over.  The system is designated to keep the operator on the seat and in the operator's compartment in the event of a tip over".
