29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and/or maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:      a) Job site, 235 North Duffy Street, Butler, PA: On or about April 28, 2016, during construction activities, the employer did not ensure that an employee driving a rough terrain forklift wore a seat belt where the unit was equipped with one for use.

29 CFR 1926.602(c)(1)(vii): Unauthorized personnel were not prohibited from riding on powered industrial trucks and/or a safe place to ride was not provided where riding of trucks was authorized:      a) Job site, 235 North Duffy Street, Butler, PA: On or about April 28, 2016, during construction activities, the employer did not ensure that appropriate safety practices were followed related to rough terrain forklift operations in that an employee was permitted to hold onto the side of the unit and ride it as it was driven around the worksite.
