29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. a) On or about May 2, 2016, H.E. Scott, Inc. dba Sta-Dry Roofing did not ensure that employees using JM Roofing System Urethane Parts 1 and 2 wore appropriate chemical resistant gloves when chemical hazards were encountered in a manner capable of causing injury or impairment through skin absorption. JM Roofing System Urethane Part 1 contains diisocyanates, which are a skin sensitizer. b) On July 19, 2016, H.E. Scott, Inc. dba Sta-Dry Roofing did not ensure that employees using JM Roofing System Urethane Parts 1 and 2 wore appropriate chemical resistant gloves when chemical hazards were encountered in a manner capable of causing injury or impairment through skin absorption. JM Roofing System Urethane Part 1 contains diisocyanates, which are a skin sensitizer. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.59: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.1200 of this chapter 29 CFR 1910.1200(e)(1)(ii): The written hazard communication program did not include the methods the employer will use to inform employees of the hazards of non routine tasks. (a) On May 2, 2016, H.E. Scott, Inc. dba Sta Dry Roofing did not include the methods the employer will use to inform employees of the hazards of non-routine tasks in the hazard communication program. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.59: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.1200 of this chapter. 29 CFR 1910.1200(h)(3)(ii): Employee training did not include the physical and health hazards of the chemicals in the work area: a) On or about May 2, 2016, H.E. Scott, Inc. dba Sta-Day Roofing did not train employees on the physical and health hazards of the chemicals in the work area. Employees were exposed to isocyanates when using JM Roofing System Urethane Adhesive Part 1. JM Roofing System Urethane Adhesive Part 1 contains diisocyanates which are skin and respiratory sensitizers. No abatement certification or documentation is required for this item.
