Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling material from unsecured storage racks.    On or about May 3, 2016, the employer did not ensure that industrial storage racks were anchored to the floor to prevent tipping and/or collapse.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:    On or about May 03, 2016, and at times prior thereto, the employer did not ensure that the wood pallets used to elevate workers were approved by the manufacturer of the powered industrial trucks, exposing employees to the hazards of falls and/or being struck by the pallet and other materials being lifted.
