OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees who unload trailers with powered industrial trucks were exposed to fall hazards due to the drivers being released and removing their vehicles from the dock prior to the unloading process being complete. a) On or about 4/4/2016, a forklift operator was unloading a tractor trailer truck when the truck driver pulled away from the dock. The forklift was on its way out of the trailer as the trailer separated from the dock forcing the forklift operator to jump from the forklift to the ground below resulting in injuries. The employer did not verify the forklift operator had exited the trailer prior to notifying the truck driver that the unloading was complete. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.178(m)(7): Brakes were not set and/or wheel blocks were not in place to prevent movement of trucks, trailers, or railroad cars while loading and unloading: a) Docking Bay: .On or about 4/4/2016, wheel chocks were not in place to prevent movement of a third party tractor trailer while it was unloaded. A forklift operator was injured when the driver pulled the tractor trailer away from the dock as the forklift was exiting the trailer. NOTE: IN ADDITION TO ABATEMENT CERTIFICAITON, THE EMPLOYER IS REQUIRED TO PROVIDE ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 IN ACCORDANCE WITH 29 CFFR 1903.19.
