29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems. Instance A: Job site, 15225th Avenue, New Brighton, PA 15066: On or about May 2, 2016, during roofing work, the employer did not ensure that employees utilized fall protection systems/devices where exposed to fall hazards of approximately 20 feet while working on pump jack scaffold in order to paint old siding. Instance B: Job site, 1522 5th Avenue, New Brighton, PA 15066: On or about May 2, 2016, during roofing work, the employer did not ensure that employees utilized fall protection systems/devices where exposed to fall hazards of approximately 14 feet 6 inches while working on ladder jack scaffold in order to install new roofing soffit and fascia.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. Jobsite: 1522 5th Avenue, New Brighton, PA 15066: On or about May 2, 2016, during roofing work, the employer did not ensure that portable ladders that were used to access an upper landing surface did not extend at least 3 feet above the upper landing surface being accessed. Ladder to access the working level of the pump jack scaffold was positioned approximately 12 inches below the working level of the pump jack scaffold.
