Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards.  a) Madison Farms Apartments - on or about May 4, 2016, employees were using a Lull telescoping forklift to raise and horizontally extend a scaffold platform to a working height of approximately 25 feet above grade, but the scaffold platform was not an approved attachment for this model of telehandler.  Among other feasible means of abatement, the employer may follow the guidelines of ANSI/ITSDF B56.6-2011, Paragraph 5.15.1a, which states that the employer must "provide a personnel platform which complies with the design requirements listed in Part III of this Standard".

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level.  a) Madison Farms Apartments - On or about May 4, 2016, employees worked from a platform attached to a Lull telescoping forklift to transport plumbing materials approximately 25 feet above a lower level to the third floor balcony, but each employee working on the platform was not protected from falling to lower levels.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) Madison Farms Apartments - on or about May 4, 2016, employees operated a Lull telescoping forklift to elevate personnel and plumbing materials to the third floor balcony, but the employer did not ensure that the operator was competent as demonstrated by successful completion of training and evaluation as specified in 1910.178 paragraph l and as referenced by the note contained in 1926.602(d).
