OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a drowning hazard:    a) This violation occurred on or about April 22, 2016 when the employer did not ensure employees walking in a grassy field inundated with water were protected from a drowning hazard.     Among other methods, a feasible and acceptable means of abatement is to:   a) implement a policy requiring a review of the topography of the area prior to allowing employees to walk on fields covered with water; b) ensure employees walking on fields covered with water are provided with U.S. Coast Guard-approved life jacket or buoyant work vests; c) provide employees walking on fields covered with water with measuring sticks.

29 CFR 1904.39(a)(1):  The employer did not orally report a fatality by telephone or in person, to the Area Office of the Occupational Safety and Health Administration (OSHA), US Department of Labor, that is nearest to the site of the incident within eight (8) hours after the death of an employee resulting from a work-related incident:    a) This violation occurred on or about April 22, 2016, when the employer did not report the drowning of an employee to OSHA within 8 hours after the death of the employee.
