OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and caught between hazards: a) Main Garage - On or before May 3, 2016, employees were exposed to being struck by the tailgate while repairing the bed of a Mack dump truck due to the potential energy of the propped open tailgate not being controlled. An employee was working under the tailgate and fatally struck by it when it released.
