29 CFR 1910.146(d)(2): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not identify and evaluate the hazards of permit spaces before employees entered: a) On or about April 28, 2016, as the controlling employer, Illinois Power Generating Company failed to identify and evaluate the potential gravity and spring energy of the 2E Coal Mill Journal Assembly prior to employees of Hi Tech Industrial Services, Inc. entering the permit required-confined space of the 2E Coal Mill.

29 CFR 1910.269(d)(2)(iii): Procedures were not developed, documented, and used for the control of potentially hazardous energy covered by paragraph (d) of this section: a) On or about April 28, 2016, As the controlling employer, Illinois Power Generating Company failed to develop, document and use procedures to control hazardous energy such as potential gravity and spring energy of the 2E Coal Mill Journal Assembly. Employees of its subcontractor, Hi Tech Industrial Services, Inc. were exposed to the unexpected movement of the Journal Mill Wheel assembly during cleaning of the 2E Coal Mill.
