OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an ejection and/or crushing hazard:    Rear parking lot:  On or about April 28, 2016, an employee was exposed to an ejection and/or crushing hazard, while operating a JLG Forklift, Model # 6042, while not utilizing/wearing the required seatbelt.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.    29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d)  Rear parking lot:  On or about April 28, 2016, an employee was exposed to an ejection and/or crushing hazard, while operating a JLG forklift, Model 6042, prior to receiving training, evaluation and being certified competent to operate a powered industrial truck.
