29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:    During work where there was potential exposure to silica dust, such as, but not limited to cleaning the baghouse, there was no identification and evaluation of air contaminant levels in order to determine adequate respiratory protection where engineering controls were not possible.     Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citation(s).

29 CFR 1910.1200(e)(1)(i): The written hazard communication program did not include a list of the hazardous chemicals known to be present, using an identity that was referenced on the appropriate material safety data sheet:    At the time of the inspection, there was no list of chemical products that included those present at the plant.  The binder of safety data sheets at the plant was not organized, including missing data sheets and no list of data sheets reflecting the data sheets in the binder. (Note: sand is a potential source of silica dust and was required to be available especially for training of health hazards associated with silica dust.) 29 CFR 1910.147(d)(4)(i): Lockout or tagout devices were not affixed to each energy isolating device by authorized employees:    During maintenance of the cement bin bag house, which required approximately six hours of work, and where an electrically motor driven belt and pulley were located, the motor was not locked out.  (Note: the fill pipe to the cement bin was tagged out, but the electrical disconnect was not locked out.)     Abatement certification and abatement documentation is required for this violation.
