29 CFR 1910.95(b)(1): When employees were subjected to sound exceeding those listed in Table G-16, feasible administrative or engineering controls were not utilized: On or about May 17, 2016, the employer failed to utilize feasible administrative or engineering controls for at least; a) One (1) two-head saw operator, who was exposed to continuous noise at 196.7% of the permissible daily noise exposure (8-hour time weighted average sound level of 90 dBA) or equivalent sound level of approximately 94.8 dBA during the 287 minute sampling period on May 17, 2016; exposure calculations included a zero increment for the 193 minutes not sampled. b) One (1) notcher operator, who was exposed to continuous noise at 206% of the permissible daily noise exposure (8-hour time weighted average sound level of 90 dBA) or equivalent sound level of approximately 95.2 dBA during the 284 minute sampling period on May 17, 2016; exposure calculations included a zero increment for the 196 minutes not sampled. c) One (1) notcher operator, who was exposed to continuous noise at 132.4% of the permissible daily noise exposure (8-hour time weighted average sound level of 90 dBA) or equivalent sound level of approximately 92 dBA during the 283 minute sampling period on May 17, 2016; exposure calculations included a zero increment for the 197 minutes not sampled.

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about May 17, 2016, the employer failed to administer an effective hearing conservation program for employees exposed to noise above the action level; including but not limited to: a) One (1) two-head saw operator, who was exposed to continuous noise at 200% of the action level (8-hour time weighted average sound level of 85 dBA) during the 287 minute sampling period on May 17, 2016; exposure calculations included a zero increment for the 193 minutes not sampled. b) One (1) notcher operator, who was exposed to continuous noise at 208% of the action level (8-hour time weighted average sound level of 85 dBA) during the 284 minute sampling period on May 17, 2016; exposure calculations included a zero increment for the 196 minutes not sampled. c) One (1) notcher operator, who was exposed to continuous noise at 133.9% of the action level (8-hour time weighted average sound level of 85 dBA) during the 283 minute sampling period on May 17, 2016; exposure calculations included a zero increment for the 197 minutes not sampled. d) One (1) 6-head saw operator, who was exposed to continuous noise at 109% of the action level (8-hour time weighted average sound level of 85 dBA) during the 269 minute sampling period on May 17, 2016; exposure calculations included a zero increment for the 211 minutes not sampled. e) One (1) nail gun operator, who was exposed to continuous noise at 122.8% of the action level (8-hour time weighted average sound level of 85 dBA) during the 279 minute sampling period on May 17, 2016; exposure calculations included a zero increment for the 201 minutes not sampled. f) One (1) auto-nailer operator, who was exposed to continuous noise at 69.2% of the action level (8-hour time weighted average sound level of 85 dBA) during the 276 minute sampling period on May 17, 2016; exposure calculations included a zero increment for the 204 minutes not sampled. g) One (1) nailer operator, who was exposed to continuous noise at 126.7% of the action level (8-hour time weighted average sound level of 85 dBA) during the 274 minute sampling period on May 17, 2016; exposure calculations included a zero increment for the 206 minutes not sampled. h) One (1) nailer operator, who was exposed to continuous noise at 122.2% of the action level (8-hour time weighted average sound level of 85 dBA) during the 271 minute sampling period on May 17, 2016; exposure calculations included a zero increment for the 209 minutes not sampled.
