29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:      a) Warehouse, on or about 5/10/16: A hearing conservation program was not developed for warehouse employees bailing aluminum and to exposed to noise at an 8-hour time weighted average (TWA) of noise at  87.5 decibels on the A scale (dBA) during the 313 minute sampling period. A zero increment was included for the 167 minutes not sampled. An effective hearing conservation program, at a minimum must include the following:        1) Monitoring employees for noise for inclusion into the program      2) Providing a baseline audiograms for employees exposed to noise above an 8-hr. TWA of 85 dBA      3) Providing annual audiograms for employees exposed to noise above an 8-hr. TWA of 85 dBA         4) Comparing annual audiograms with baselines to determine if employees have standard threshold shift (STS)      5) Retesting, refitting and retraining employees incurring an STS.      7) Providing hearing protection for employees exposed to noise above an 8 hr. TWA of noise of 85 dBA.      8) Providing hearing conservation training for employees exposed to an 8-hr. TWA of noise above 85 dBA.     Abatement certification must be submitted for this item.
