29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required. Windy Acquisitions, LLC failed to submit documents to OSHA verifying that each of the following cited violations had been corrected: Citation Number Item Number Abatement Date 1 1 7/15/16 In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: On or about May 10, 2016, employees of Kristine's Shower were mixing raw ingredients together including, but not limited to, citric acid. The employer did not develop, implement, and/or maintain a written hazard communication program. The employees are exposed to hazards associated with exposure to citric acid. Abatement documentation and certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: On or about May 10, 2016, employees of Kristine's Shower, which were mixing and producing the bath soaps and fizzies, were using filtering facepiece dust masks on a voluntary basis. The employer did not provide the respirator users with the information contained in Appendix D to 29 CFR 1910.134. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
