29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    On May 11, 2016 located on the northeast side of a commercial structure parapet wall, there was no frequent and regular inspections being performed by a competent person to ensure the job-site, materials and equipment such as residential fall protection systems and/or devices were being maintained and utilized in a safe condition.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.501(b)(2)(i): Each employee who is constructing a leading edge 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, or personal fall arrest systems. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.    Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    On May 11, 2016, located on the northeast side of a commercial structure, an employee was observed not utilizing any fall protection system while exposed to a fall hazard constructing framing work at the leading edge of the parapet wall.  Employee was exposed to a potential fall height of 24'-8".    The Vincente Mancinas dba: Vincent Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(2)(I), which was contained in OSHA inspection number 1080414 , citation number 1, item number 1 and was affirmed as a final order on 10/20/2015, with respect to a workplace located at 8195 Colerain Ave, Cincinnati, OH 45239.
