29 CFR 1910.147(c)(4)(i): Procedures were not utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:     A)    Fresh Unlimited, Inc. DBA Freshway Foods, located at 601 North Stolle Avenue, Sidney, OH 45365: On or about February 11, 2016, the employer did not implement procedures to control hazardous energy of the equipment such as, but not limited to, the Old Onion Line. Employees did not control all hazardous energy sources such as, but not limited to, electrical before performing activities such as, but not limited to, cleaning the lines scoring knives. Employees were exposed to amputation hazards while all hazardous energy sources were not controlled prior to conducting work.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics was not provided to the operator when the operator was involved in an accident or near-miss incident:    A)    Fresh Unlimited, Inc. DBA Freshway Foods, located at 601 North Stolle Avenue, Sidney, OH 45365: On or about February 29, 2016, the employer did not provide refresher training in safe operation of sit-down powered industrial vehicles for the employee who was involved in an accident while driving one the Crown forklift (5200 Series, Serial # 9A198176) in P-Label Station area. The operator pinned another employee's left foot and ankle between the skids with product. Employees were exposed to struck-by hazards due to the lack of refresher training.

DBA Freshway Foods, located at 601 North Stolle Avenue, Sidney, OH 45365: On or about April 21, 2016, the employer did not ensure that one or more methods of machine guarding were provided to protect employees from nip-point hazards created by moving parts such as, but not limited to, the rotating pulley and the product weight belt of the Line 1 product conveyor. Employees were exposed to ingoing nip-points and caught-in hazards.
