29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  On July 12, 2016, Brad Smith dba Brad Smith Construction was issued citations and the employer did not verify, through written certification that each citation was abated.  Abatement certification was not received for the following violations:              a.  Citation 1 Item 1 and,          b.  Citation 1 Item 2  Brad Smith dba Brad Smith Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1903.19(c)(1), which was contained in OSHA inspection number 1096483, citation number 2, item number 1 and was affirmed as a final order on 03/10/2016, with respect to a workplace located at W. Farmington Rd & N. Pierson Ave., Peoria, IL.

Abatement documentation was not received for the following violations:              Citation 1 Item 3.  Brad Smith dba Brad Smith Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1903.19(d)(1), which was contained in OSHA inspection number 1096483, citation number 2, item number 2 and was affirmed as a final order on 03/10/2016, with respect to a workplace located at W. Farmington Rd & N. Pierson Ave., Peoria, IL.

29 CFR 1926.451(g)(1):   Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  On or about May 12, 2016 an employee performing roofing activities from a scissor lift was exposed to a fall hazard of approximately 20 feet and the scissor lift's entryway was not protected by standard guardrails and no other fall protection was being used.

29 CFR 1926.1053(b)(1):   Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  On or about May 12, 2016 employees used an extension ladder to access a roof approximately 10 feet from the ground and the employer did not ensure that the ladder's side rails extended at least three feet above the roof's eave.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  On or about May 12, 2016 employees performing roofing activities were exposed to fall hazards up to approximately 20 feet and a competent person did not inspect the job site and ensure hazards were eliminated or controlled.  Brad Smith was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1096483, citation number 1, item number 1a and was affirmed as a final order on January 14, 2016, with respect to a workplace located at W Farmington Rd and N Pierson Ave.
