Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from recognized struck-by and/or crushed-by hazards that are causing or likely to cause death or serious physical harm to his employees: In the storage area of the facility where employees were exposed to a struck-by hazard from a storage rack system: a) The storage rack system not having plaques containing the maximum permissible unit load and/or maximum uniformly distributed load per level, and/or the racking system did not have the maximum total load per bay; b) The storage rack system was not anchored to the ground; c) Storage rack support members were damaged.
