29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  a) At the jobsite, employees were not wearing hard hats in an area where 2x2x144 inch wood planks were being dropped from the roof, on or about April 28, 2016.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) At the jobsite, employees were exposed to a 12'-1" fall hazard, in that, fall protection was not used while installing a Gerard Stone Coated Metal Roof on a 12:12 pitch roof, on or about April 28, 2016.

An employee fell from a ladder on April 28, 2016 and was transported to the hospital. The employee passed away on April 30, 2016 and the employer did not report the fatality to OSHA.
