29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    a. At the site, the employer did not establish an energy control program when employees performed service and maintenance, such as but not limited to, cleaning dough from the divider machine when it jammed. On or about March 16, 2016 an employee sustained amputations to the fingers when trying to clean dough out of a divider machine while it was running.

29 CFR 1910.263(f)(3): Rear of divider. The back of the divider shall have a complete cover to enclose all of the moving parts, or each individual part shall be enclosed or guarded to remove the separate hazards. The rear cover shall be provided with a limit switch in order that the machine cannot operate when this cover is open. The guard on the back shall be hinged so that it cannot be completely removed and if a catch or brace is provided for holding the cover open, it shall be designed so that it will not release due to vibrations or minor bumping whereby the cover may drop on an employee.    a. The Lippet KG divider, type T4SP MKB-SCHR-KB, Fabr Nr.-03,1307, did not have a limit switch on the back cover that would stop the machine when the cover was opened.

One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.    a. On the Lippet KG divider, type T4SP MKB-SCHR-KB, Fabr Nr.-03,1307, the employer did not ensure the safety switch attached to the gate of the dough feeding area was in working order.

Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.
