29 CRF 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.      A. Cowden Construction LLC worksite located at 690 Chippewa Lane, Perrysburg, Ohio: On or about May 12, 2016, the employer failed to instruct all employees in the recognition and avoidance of hazards commonly seen in the residential construction industry. Involved employees were not effectively trained to recognize and avoid hazards including but not limited to the lack of eye protection and lift platform use.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   Cowden Construction LLC worksite located at 690 Chippewa Lane, Perrysburg, Ohio: On or about May 12, 2016, the employer had not trained employees in the appropriate use of fall protection, such as but not limited to, the use of personal fall arrest systems while performing various framing operations on the two story residential structure. Employees were exposed to fall hazards.

29 CFR 1926.95(a):  Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.     A. Cowden Construction LLC worksite located at 690 Chippewa Lane, Perrysburg, Ohio: On or about May 12, 2016, the employer did not ensure employees were provided with proper eye protection while operating pneumatic nail guns and circular saws while installing sheeting. Two employees were exposed to potential flying object hazards while operating the tools on the roof of the two story residential structure.

Cowden Construction LLC worksite located at 690 Chippewa Lane, Perrysburg, Ohio: On or about May 12, 2016, employees were exposed to fall hazards while working/standing on the 4 x 8 foot sheets of plywood suspended by the rough terrain lift. The platform was not designed and/or constructed properly to ensure employees were not exposed to fall hazards.

The employees were exposed to a fall distance of approximately 18.00 feet.
