OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On 05/18/2016, employees working at CSC Serviceworks located at 12942 Hollenberg Drive, Bridgeton, MO, were provided an Allis Chalmers forklift (Model: ACC40L PS, S/N: AHB83181) which did not have a seat belt to protect the operator. This forklift (Powered Industrial Truck) was not in compliance with the ANSI/ITSDF B56.1-2005 7.41 standard for Powered Industrial Trucks nor the ASME B56.1-1993 - Safety Standard for Low Lift and High Lift Trucks. Section 7.41 of the ANSI/ITSDF requires a restraint system to protect the operator from being struck-by or caught between the lift and the ground surface. Both standards require the use of the restraint system. One method of abatement is to have a seat belt installed as required by the ANSI/ITSDF B56.1-2005 paragraph 7.41 and the ASME B56.1-1993 standards. DISCLAIMER: a) The employer is not limited to the abatement method(s) suggested by OSHA. b) The employer is responsible for selecting and implementing an effective abatement method.

29 CFR 1910.215(a)(4): Work rests. On offhand grinding machines, work rests shall be used to support the work. They shall be of rigid construction and designed to be adjustable to compensate for wheel wear. Work rests shall be kept adjusted closely to the wheel with a maximum opening of one-eighth inch to prevent the work from being jammed between the wheel and the rest, which may cause wheel breakage. The work rest shall be securely clamped after each adjustment. The adjustment shall not be made with the wheel in motion: On or about 05/18/2016, employees working at CSC Serviceworks located at 12942 Hollenberg Drive, Bridgeton, MO, the employer had a Collins Quality Tool 6 bench grinder (S/N: C-9201.51216) which was lacking a work rest.

29 CFR 1910.215(b)(9): Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch. (See Figures O-18, O-19, O-20, O-21, O-22, and O-23.): On or about 05/18/2016, employees working at CSC Serviceworks located at 12942 Hollenberg Drive, Bridgeton, MO, the employer had a Collins Quality Tool 6 bench grinder (S/N: C-9201.51216) which was lacking a tongue guard.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA: On 05/13/2016, CSC Serviceworks located at 12942 Hollenberg Drive, Bridgeton, MO, reported an in-patient hospitalization of one their employees. The employee was injured in 05/11/2016 at approximately 11:30 am and the employer reported this incident to OSHA on 05/13/2016 at approximately 10:30 am. CSC Serviceworks did not report the in-patient hospitalization within twenty-four (24) hours of the hospitalization.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years: On or about 05/18/2016, employees working at CSC Serviceworks located at 12942 Hollenberg Drive, Bridgeton, MO, were operating forklifts without having completed the required refresher training. The operators had attended training in 04/26/2013, but had not completed the 3 year refresher training/evaluation since. It was reported that one of the employees came to the company with previous forklift training but not evaluated and updated at this companys location.
