29 CFR 1926.300(b)(2): Moving part(s) of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded: a) For employees working at 1051 Winding Pines Circle in Cape Coral, as observed on or about May 18, 2016. Employees were using a portable plaster and mortar mixer that was equipped with a guard that did not close enough to protect the employees from the moving mixer paddle blades. The guard was bent to allow for an approximate 6 inch opening.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours. a) For employees working at 1051 Winding Pines Circle in Cape Coral, as observed on or about May 18, 2016. Employees were using a portable plaster and mortar mixer to mix stucco where one of the employee's suffered an amputation. The employer failed to report the amputation to OSHA.
