29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required:   a. In regards to citation 1, item 1, issued on July 11, 2016, the employer has failed to submit abatement certification and documentation within ten days of the abatement date, July 25, 2016.  The violation read as follows:       29 CFR 1910.178(m)(6): A safe distance shall be maintained from the edge of ramps or platforms while on any elevated dock, or platform or freight car. Trucks shall not be used for opening or closing freight doors:     a. Located at Dock 21 at 4540 Fisher Road in Columbus, Ohio: On or about March 3, 2016, employees were attempting to push the top of a semi-trailer door closed from an elevated dock with the forks of a Hyster (model S50FT) propane powered forklift. The condition exposed employees to struck-by and crushed-by hazards.           b. In regards to citation 1, item 2, issued on July 11, 2016, the employer has failed to submit abatement certification and documentation within ten days of the abatement date, July 25, 2016. You must enter each recordable injury or illness on the OSHA 300 Log and 301 Incident Report within seven (7) calendar days of receiving information that a recordable injury or illness has occurred:     a. Located at 4540 Fisher Road in Columbus, Ohio: On or about March 3, 2016, an employee was fatally injured after being crushed between a semi-trailer and a loading dock. The employer did not record the injury on the OSHA 300 Log and 301 Incident Report within seven days of being notified.           c. In regards to citation 2, item 3, issued on July 11, 2016,  the employer has failed to submit abatement certification and documentation within ten days of the abatement date, July 21, 2016.  The violation read as follows:       29 CFR 1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation:     a. Located at 4540 Fisher Road in Columbus, Ohio: The employer did not certify that the employees who operate forklifts at the facility were trained and evaluated on the safe operation of the lift.
