29 CFR 1960.8(a):  The Agency head did not furnish employment and a place of employment to each employee that were free from recognized hazards that caused or were likely to cause death or serious physical harm:    U.S. Dept. of Agriculture- Nantahala national Forest District, Cheoah Ranger District:        a) Employees were exposed to the hazard of falling while operating riding lawn, such as a Bush Hog zero turn (ES2044KH5), Cub Cadet (Z-Force S 60), John Deere (GX 335) and John Deere zero turn (910A) on a hill with slopes greater than 15 degrees. The employer failed to institute alternative methods such as, but not limited to, weed eating the sloped embankments rather than mowing.     b) On or about 05/19/2016, at the workplace, the employer did not ensure that Rollover Protective Structures (ROPS) and seatbelts were installed on the Cub Cadet (Z Force S 60) zero turn mower and John Deere riding mower (GX 335) in accordance with manufacturer's instructions to prevent injury and/or death in the event of a roll over.        Notice01, Item 002, as required by 29 CFR 1960.8(a):  The employer was cited for the same standard on 06/24/2015, inspection # 1074324, 08/24/2015 of the final order and was abated by revising the JHA to include: No mowing operations in area with a slope greater than 17 degrees without seatbelt and ROPs.  Each affected employee shall read and be familiar with the owners/operator manual prior to use.
