29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)    (a) Building #1 - On or about May 18, 2016 the employer had not documented and implemented a written hazard communication program for employees performing painting and caulking activities.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest system:    (a) Building #1 - On or about May 18, 2016 employees working from second story balcony 12 feet 6 inches high were not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest system exposing employees to fall hazard.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:    (a) Building #1 - On or about May 18, 2016 employees using stairs without a guardrail system to access the second floor balcony in order to perform caulking activities were exposed to a fall hazard.
