29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toe-boards: Note:  Toe-boards are only required wherever, beneath the open sides, persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard:   (a) Worksite - Fuel Loading Platform:  On or about 5/23/2016, employees were not protected from falls while working from the fuel oil truck loading platform, which is approximately six to seven feet above the lower level.
