29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  Two employees were exposed to cave-in and struck by issues while working in an approximately 20 foot long by 3 foot wide and 9 foot deep trench.   The employer did ensure that such inspections of the jobsite were made by a competent person of the adjacent areas, and protective systems.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    A 6 foot high portion of a Davidson Step Ladder was used to access and egress from a 4 foot 9 inch deep portion of a 20 foot long by 3 foot wide and 9 foot deep trench, and the ladder's length did not extend at least 3 feet above the edge of the trench.
