29 CFR 1910.305(e)(1): Cabinets, cutout boxes, fittings, boxes, and panelboard enclosures. Cabinets, cutout boxes, fittings, boxes, and panelboard enclosures in damp or wet locations shall be installed so as to prevent moisture or water from entering and accumulating within the enclosures and shall be mounted so there is at least 6.35-mm (0.25-in.) airspace between the enclosure and the wall or other supporting surface. However, nonmetallic enclosures may be installed without the airspace on a concrete, masonry, tile, or similar surface. The enclosures shall be weatherproof in wet locations. a. At the worksite located at 1380 North Hamilton Road, employees who worked in the right side grill area used equipment and prepared customer orders near a steam table, microwave oven and toaster near an electrical box with a loose cover. The employer did not ensure that the electrical box cover was flush against the wall and sealed against moisture to avoid exposing employees to an electrical shock hazard.

29 CFR 1910.305(j)(2)(iv): A receptacle installed in a wet or damp location shall be suitable for the location. a. At the work site located at 1380 North Hamilton Road, kitchen employees used two regular receptacles marked "convenience" by the employer, as electrical supply for commercial grade microwave and toaster ovens on the right side of the order preparation area. The receptacles were located directly above the steam table where employees added water several times daily, exposing employees to electrical shock. b. 29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: a. At the work site located at 1380 North Hamilton Road, Columbus, Ohio, the employer had not assessed the workplace to determine what hazards were present for employees. Employees who changed hot oil in a broaster and two fryers were exposed to injuries that included (but were not limited to) burns and eye injuries.
