29 CFR 1910.157(g)(1): An educational program was not provided for all employees to familiarize them with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting:    (a)Allied Concessions Group:  On and before May 18th, 2016, the employer did not ensure an educational program was not provided for all employees to familiarize them with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting.  Employees use ethanol in the hash oil refining process.  The ethanol is heated creating a flammable vapor.  This condition exposed employees to fire hazards.     Abatement Note: An emergency action plan in writing, kept in the workplace, and available to employees for review is a feasible abatement method. An emergency action plan must include at a minimum:     (1)Procedures for reporting a fire or other emergency;  (2)Procedures for emergency evacuation, including type of evacuation and exit route assignments;  (3)Procedures to be followed by employees who remain to operate critical plant operations before they evacuate;  (4)Procedures to account for all employees after evacuation;  (5)Procedures to be followed by employees performing rescue or medical duties; and  (6)The name or job title of every employee who may be contacted by employees who need more information about the plan or an explanation of their duties under the plan.

29 CFR 1910.307(c)(2)(i): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location:    (a) Allied Concessions Group, at 2121 South Jason St. Unit A., Denver, CO: On and preceding 5/18/16, the employer did not ensure that equipment, wiring methods, and installations of equipment in hazardous (classified) locations were intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location. Employees use ethanol in the hash oil refining process.  The ethanol is heated creating a flammable vapor.  The hot plates, duplex outlets, and ceiling lights located within the hash oil refining room are not approved for a Class I Division 1 location. This condition exposed employees to a flash fire hazard due to the potential for an ignition source in a room where flammable vapors are present.    (b) Allied Concessions Group, at 2121 South Jason St. Unit A., Denver, CO: On and preceding 5/18/16, the employer did not ensure that equipment, wiring methods, and installations of equipment in hazardous (classified) locations were intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location. Employees use ethanol in the hash oil refining process.  The ethanol is heated creating a flammable vapor.  The Heidolph Rotary Evaporators, duplex outlets, and ceiling lights located within the hash oil refining room are not approved for a Class I Division 1 location. This condition exposed employees to a flash fire hazard due to the potential for an ignition source in a room where flammable vapors are present.      Abatement Note:  Among other methods, appropriate abatement methods include:  (1) Installation of engineering controls, such as chemical fume hoods, which exhausts flammable or combustible vapors from the room.

This condition exposed employees to a chemical hazard.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment had been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d):    (a) Allied Concessions Group, at 2121 South Jason St. Unit A., Denver, CO: On and preceding 5/18/16, the employer did not verify that the required workplace hazard assessment had been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d). Employees performed duties in the extraction and refining area to extract hash oil from cannabis trim. The employer had implemented work rules for the use of PPE; however a workplace assessment had not been performed and certified by the employer. Employees performed operations where they were exposed to chemical hazards, including but not limited to the following:    1. Chemicals hazards while working with carbon dioxide, polyethylene glycol, ethyl alcohol.

Employees ground the cannabis trim. The employer allowed employees to voluntarily wear particulate filtering facepiece respirators (dust masks). The employer had not provided the basic advisory information on respirators.  This condition potentially exposed employees to a respiratory hazard.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.    (a) Allied Concessions Group at 2121 South Jason Street Unit A, Denver CO 80223: On and preceding 5/18/2016, the employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area such as, but not limited to:     1. Carbon dioxide;   2. Polyethylene Glycol 400; and  3. Ethyl Alcohol 190 Proof.    Organa Labs was previously cited for a violation of this Occupational Safety and Health Administration Standard or its equivalent standard, 29 CFR 1910.1200(h)(1), which was contained in OSHA inspection 1075964, Citation 1, Item 1b and was issued on 1/20/2016, and affirmed as a final order on 2/12/2016, with respect to a workplace located at 2121 South Jason Street Unit A, Denver CO 80223.
