29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. (a) Inlet No. 3 - On or about May 23, 2016 two employees were exposed to a falling object hazard while working beneath loose soil inside a 6.2 feet deep trench. including the spoil pile. Employees were not wearing hardhats while an excavator was in operation.

29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. (a) Inlet No. 3 - On or about May 23, 2016 two employees were working inside a 6.2 feet deep trench including the spoil pile with no means of egress. There was no ladder in the trench.

29 CFR 1926.652(a): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) Inlet No. 3 - On or about May 23, 2016 two employees were exposed to cave-in hazard from loose soil due to the soil pile not being moved 2 feet away from the hole. Employees were not protected from trench cave-in by use of sloping or shoring.
