29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:    (a) New residential construction on Lot #3, Front side: On or about May 31, 2016, and at times prior, the employer exposed employee to struck-by head injuries from materials elevated on a material hoist, in that a protective helmet was not provided to the ground employee hoisting bundles of shingles to the roof.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    (a) New residential construction on Lot #3, Roof: On or about May 31, 2016, and at times prior, the employer exposed employees to eye injuries while using pneumatic roofing nail guns at 135 PSI, in that protective eyewear was not provided to employees engaged in shingle installation.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     (a) New residential construction on Lot #3, Roof: On or about May 31, 2016, and at times prior, the employer exposed employees to fall hazards of 20-feet, 7-inches from the lower level, in that personal fall arrest was not provided to the employee loading the roof with shingles.
