29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury:     (a) On or about May 28, 2016, Nieves Roofing, Inc. did not ensure that eye and face protection were used by employees when machines or operations presented potential eye or face injury. An employee of Nieves Roofing, Inc. was observed nailing shingles on a residential roof, using a pneumatic gun, without any eye or face protection. 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:     (a) On or about May 28, 2016, Nieves Roofing, Inc. did not ensure that its employees were protected from falls while working at heights greater than 6 feet. An employee of Nieves Roofing, Inc. was exposed to fall hazards in excess of 11 feet while engaged in roofing activities on the roof of a residential building with no fall protection in place.
