29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New townhome construction, third floor: On or about June 1, 2016, and at times prior, the employer exposed employees to fall hazards of 21-feet, 7-inches from the third floor working surface, in that a fall protection system was not provided to employees while engaged in framing activities. (b) New townhome construction, Second floor top plate: On or about June 1, 2016, and at times prior, the employer exposed employees to fall hazards of 20-feet, 6-inches to the lower level, in that a fall protection system was not provided to employees while engaged in framing activities.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees: (a) New townhome construction, garage: On or about June 1, 2016, and at times prior, the employer failed to inspect all the electrical cords prior to the start of the shift, in that a 50-foot extension cord had a damaged strain relief which exposed the internal wires which was not repaired or removed from service.
