29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury.  On or about 27 May 2016 and at times prior thereto, the employer failed to provide hazard recognition and safety training to four employees performing framing activities on a residence under construction, exposing the employees to hazards including, but not limited to, being struck in the eyes and head by flying or falling objects, using the top and top step of a ladder and falling from a height of approximately 9 feet to the ground below.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  On or about 27 May 2016 and at times prior thereto, two employees without head protection were handing materials from ground level to two other employees working approximately 9 feet above, exposing the two ground level employees to the hazard of being struck by falling materials.

On or about 27 May 2016, three employees without eye protection were using pneumatic nail guns to perform framing activities on a residence under construction, exposing the employees to the hazard of being struck by flying objects.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step.  On or about 27 May 2016, two employees performing framing activities used the top and top step of a portable step ladder to access the top of the first story walls of a residence under construction, exposing the employees to the hazard of falling approximately 6 feet to the ground below.
