29 CFR 1926.501(b)(10): 29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, warning line system and personal fall arrest system, or warning line system and safety monitoring system; or, on roofs 50 feet (15.25 m) or less in width, the use of a safety monitoring system alone: a) On or about 06/01/16 on construction jobsite at a house located at 750 Humboldt Pkwy., Buffalo, NY: Employees used an extension ladder to access and exit the upper roof from the porch roof below, and also used the ladder as a work surface for tearing off the upper roof. Employees were exposed to a fall of approx. 12 ft. from the low slope porch roof when walking on the porch roof, bagging roofing debris, and placing the bags of debris at the edge of the roof. No fall protection system was used to protect the employees from falling off the porch roof. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support): a) On or about 06/01/16 on construction jobsite at a house located at 750 Humboldt Pkwy., Buffalo, NY: Employees used an extension ladder to access and exit the upper roof from the porch roof below. An employee also used the ladder as a work surface for tearing off the upper roof. In order to meet the criteria of this standard, the ladder is required to have a pitch of approx. 75.5 degrees with the horizontal. The ladder that the employees were using had a pitch of approx. 61 degrees with the horizontal. NO ABATEMENT CERTIFICATION REQUIRED
