29 CFR 1926.20(b)(2): Programs did not provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers:  a) Building E: On June 2, 2016 and at times prior thereto the controlling employer, Dave Evans Construction did not ensure through frequent and regular inspections of the jobsite activities that its framing sub-contractor protected their employees.  As the work site progressed, fall protection systems that had been in place were not maintained.  Guardrail systems at the balconies on the second and third floors were removed or partially removed, exposing employees to 10 foot fall hazards to a lower level.   b) Building E: On June 2, 2016 and at times prior thereto the controlling employer, Dave Evans Construction did not ensure through frequent and regular inspections of the jobsite activities that its framing sub-contractor protected their employees.  A 10 foot self-supporting ladder with broken metal spreader bars/locking devices was used for access to the third floor.    Note) Certification of corrective action IS required for this item.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system:  a) Building E: On June 2, 2016 the controlling employer, Dave Evans Construction, did not ensure that its framing sub-contractor protected their employees from fall hazards.  Complete guardrail systems were not in place on the second and third floor balcony openings, exposing the sub-contractor employees to 10 foot falls to the lower level and/or ground below.     Note) Certification of corrective action IS required for this item.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:  a) Third floor access, building E: On June 2, 2016 the controlling employer, Dave Evans Construction, did not ensure that its framing sub-contractor protected their employees from the hazards of continuous use of an unserviceable, self-supporting ladder.  Defects included unserviceable metal spreaders/locking devices.    Note) Certification of corrective action IS required for this item.
