A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. a. On or about June 6, 2016, at the above addressed jobsite, an employee conducting utility operations in a trench sixty five (65') feet long, seven (7') feet and three (3") inches in depth was not provided with means of egress within 25 feet of work location.

29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a. On or about June 6, 2016, at the above addressed jobsite, the competent person was aware of an excavation with hazardous condition(s), lack of cave in protection and egress. The competent person did not remove the exposed employee(s) from the hazard, thereby exposing employees to hazards associated with trench collapse.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: a. On or about June 6, 2016, at the above addressed jobsite, an employee was conducting utility operations in a trench measured at seven (7') feet three (3") inches in depth. The trench was not provided with cave in protection, thereby exposing the employee to cave in hazards.
