29 CFR 1926.55(a): Employee(s) were exposed to material(s) at concentrations above those specified in the Threshold Limit Values of Airborne Contaminants for 1970 of the American Conference of Governmental Industrial Hygienists:    On or about June 7th, 2016, at the jobsite located at 3200 S University Dr. Fort Lauderdale, FL 33328:    a. An employee  driving a ride-on scrapper vehicle with the purpose of removing tiles over concrete, was over-exposed to respirable silica dust at a concentration of 2.87 mg/m3 (equivalent to 28.71 mppcf) expressed as an 8 hour time-weighted average of 2.18 times the daily Permissible Exposure Limit (PEL) of 1.23 mg/m3 (equivalent to 12.25 mppcf) based on a 395 minute sampling period; exposure calculations included a zero increment for the 85 minutes not sampled.    b. An employee engaged in sweeping the debris and dust  produced by the scrapper, was over-exposed to respirable silica dust at a concentration of 2.6 mg/m3 (equivalent to 26.03 mppcf) expressed as an 8 hour time-weighted average of 1.99 times the daily Permissible Exposure Limit (PEL) of 1.21 mg/m3 (equivalent to 12.09 mppcf) based on a 390 minute sampling period; exposure calculations included a zero increment for the 90 minutes not sampled.

29 CFR 1926.55(b): When administrative or engineering controls were not feasible to achieve full compliance, protective equipment or other protective measures were not used to keep the exposure of employees to air contaminants within the limits prescribed by 29 CFR 1926.55:  On or about June 7th, 2016, at the jobsite located at 3200 S University Dr. Fort Lauderdale, FL 33328, the employer did not implanted feasible administrative or engineering controls for:  a. 29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103)    On or about June 7th, 2016, at the jobsite located at 3200 S University Dr. Fort Lauderdale, FL 33328, the employer did not develop and implement a respiratory protection program for employees who are required to wear a filtering facepiece air purifying respirator 3M, N95  Model 8210 and a tight fitting respirator 3M Model 7502.
