29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): a) Lot on Route 7 and Newtown, Bear, DE-On or about June 7, 2016, the employer failed to provide cave-in protection to ensure two employees who were inside an excavation were protected. The excavation was measured at approximately 5 ft. 7 in. in depth, 5 to 10 feet in width and 21 feet in length. The soil was sandy clay cohesive, type "B". Note: Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written documentation.

The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
