29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a. On or about June 3, 2016 and times prior thereto, throughout the facility employees were exposed to struck-by hazards when operating a modified Hyster Forklift, Model H100, without the manufacturers prior written approval to install and use Allied Systems forging clamp, Model SQ8 and a metal guard over the windshield. b. On or about June 3, 2016 and times prior thereto, throughout the facility employees were exposed to struck-by hazards when operating a modified Hyster Forklift, Model H360, without the manufacturers prior written approval to install and use Allied Systems forging clamp, Model SQ20.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about June 3, 2016, in the NE area of the facility, employees were exposed to struck-by hazards when operating equipment around a Erie Hammer Press, SN 12792, without one or more method of machine guarding to protect from hazards created by point of operation and flying chips. In the Alternative OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by a knockout projectile. On or about June 3, 2016, in the NE area of the facility, employees were exposed to struck-by hazards when using an Erie Hammer Press and knockouts to release a weld neck flange from a die.
