29 CFR 1926.416(a)(3): Before work began, the employer did not ascertain by inquiry, direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, was so located that the performance of the work could bring any person, tool, or machine into physical or electrical contact with the electric power circuit:  (a) On or about 6/8/2016 - 1423 Montclair Road, Birmingham, AL, employees were engaged in metal roofing activities on a two-story apartment complex in close proximity to an energized power line of 240 volts located near the front right corner of the building.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:  (a) On or about 6/8/2016 - 1423 Montclair Road, Birmingham, AL, employees engaged in metal roofing activities on a two-story apartment complex were exposed to falls of approximately 17 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    (a) On or about 6/8/2016 - 1423 Montclair Road, Birmingham, AL, employees were climbing up and/or down an extension ladder positioned on the side of a roof with only two feet extended beyond the landing surface of the two-story apartment complex exposing them to falls of approximately 17 feet.
