29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:    (a) New residential construction on Lot #93, South side: On or about June 9, 2016, and at times prior, the employer exposed employees to electrical shock hazards while using an electrical junction box connected to an extension cord, in that the makeshift power strip/junction box is intended for indoor use and is manufactured to be fixed to a support within a structure.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:    (a) New residential construction lot #93, First floor stairway: On or about June 9 2016, and at times prior, the employer exposed employees to fall hazards up to 4-feet, 6-inches on a stairway, in that stair rails were not provided on a stairway which was 8 risers high and 4-feet, 6-inches from the lower level from the first floor to the landing leading toward the second level.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:    (a) New residential construction on Lot #93, South side: On or about June 6, 2016, and times prior, the employer exposed employees to fall hazards of 24-feet, 2-inches from the pump jack scaffold platform, in that fall arrest was not provided to employees while installing cornice boards.       Garcia's, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.501(g)(1), which was contained in OSHA inspection number 1043416, citation number 1, item number 2 and was affirmed as a final order on 03/30/2015, with respect to a workplace located at 1805 Dearborne Lane, Alpharetta, GA 30009.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  (a) New residential construction, South side: On or about June 9, 2016, and at times prior, the employer failed to inspect all of the electrical cords prior to the start of the work shift. Extension cords used to power circular saws had torn outer casing, missing ground pins and not removed from service.
