29 CFR 1910.119(e)(5): The employer did not establish a system to promptly address the team's findings and recommendations; assure that the recommendations were resolved in a timely manner and that the resolution was documented; document what actions were to be taken; complete actions as soon as possible; develop a written schedule of when these actions were to be completed; communicate the actions to operating, maintenance and other employees whose work assignments were in the process and who may be affected by the recommendations or actions.  On or about 7 June 2016, and at times prior thereto, the employer did not establish a system to promptly address the recommendations from the November 2014 Hazard Operability (HAZOP) Process Hazard Analysis (PHA), exposing employees working within the process area to fire and explosion hazards.

29 CFR 1910.119(f)(1)(ii): 29 CFR 1910.119(f)(1)(ii):  The employer did not develop and implement written operating procedures that provided clear instructions for safely conducting activities involved in each covered process consistent with the process safety information that addressed operating limits, specifically the consequences of deviation and the steps required to correct or avoid deviation.  On or about 7 June 2016, and at times prior thereto, the employer did not have the consequences of deviation and the steps required to correct or avoid deviation within the operating procedures for the processing units, exposing employees working within the process area to fire and explosion hazards.

At the inspection site, for calendar year 2015, the OSHA Form 300A Summary of Work-Related Injuries and Illnesses was not signed and certified by February 1st, but was instead signed and posted on April 12, 2016.

On or about 7 June 2016, and at times prior thereto, an incident investigation report with root cause and recommendations conducted for a release in June 2015 was not retained for five years, exposing employees working within the process area to fire and explosion hazards.
