OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while working from an elevated work platform supported by a powered industrial truck: a. Shop- An employee was exposed to a fall of approximately 15 feet while working from a wood pallet supported by a Toyota 8FGU20 forklift. The employee was moving chains which are choked around the bottom chord of the bar joists in the ceiling and the chains are used to suspend the front or rear end of utility vehicles, snowmobiles, and motorcycles while they are repaired. The wood pallet was not a suitable work platform and the employee on the wood pallet did not have fall protection.
