OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from a commercial riding lawnmower equipped with ROPs overturning or from the operator falling off the mower, due to the fact that the operator restraint systems (seatbelts) provided on the mower were not used by the operator. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to require and to effectively enforce the use of the operator restraint systems provided by the manufacturer of the riding lawnmowers. a) South Federal Credit Union lawn: An employee operating a Husqvarna riding lawnmower was observed not wearing the seatbelt provided. b) Marion Avenue: An employee operating a Dixie Chopper riding lawnmower was observed not wearing the seatbelt provided.

29 CFR 1910.106(g)(3)(iv)(d): The dispensing units, except those attached to containers, were not mounted on either a concrete island or protected against collision damage by suitable means. a) East side of Lay-Down Yard: A 500 gallon double walled tank containing gasoline was not protected from vehicular collision by the use of (at a minimum) an awareness barrier or warning line. b) East side of Lay-Down Yard: A 500 gallon double walled tank containing diesel fuel was not protected from vehicular collision by the use of (at a minimum) an awareness barrier or warning line.
