OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards:       On or About 6/4/16 and 6/6/16      Location Storage/Warehouse Area, 1170 Bronx River Avenue, Bronx, NY 10472      a) Employees were exposed to being struck by storage racks and their contents. A worker was fatally injured when a storage rack collapsed and pinned him against another storage rack. Storage racks in the facility were not secured to prevent tipping, were not inspected and were not repaired or replaced when damaged.    Among other methods, the following feasible and acceptable abatement methods to correct this hazard are to follow the requirements outlined in ANSI Standard MH16.1 2012 Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks paragraphs 1.4.1 and 1.4.7:       1) Maintain the structural integrity of rack systems by assuring proper operational, housekeeping, and maintenance procedures including but not limited to:      a) Regularly inspect rack systems for damage; when damage is found isolate and remove from use until repaired or replaced in accordance with paragraph 1.4.1.      b) Bolt or otherwise secure rack systems into the concrete floor in accordance with paragraph 1.4.7.    NOTE: The employer is not limited to the abatement method(s) suggested by OSHA.  The employer is responsible for selecting and implementing an effective abatement method.
