29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment:  On or about June 23, 2016, in the facility, employees required to perform welding operations were exposed to noise in excess of 85 dBA (8-hour TWA) or, equivalently, a dose of fifty percent.  A continuing, effective hearing conservation program had not ben implemented tp protect employees against the hazard of hearing loss:  a. An employee welding at the C-Line Finish area was exposed to continuous noise at an 8-hour time-weighted average sound level (TWA) of 93.8 dBA or, equivalently, a dose of 169.2 percent during an approximate 480 minute sampling period.  b. An employee welding at the E-Line Shoes area was exposed to continuous noise at an 8-hour time-weighted average sound level (TWA) of 88.1 dBA or, equivalently, a dose of 77.2 percent, during an approximate 480 minute sampling period.    c. An employee welding at the E-Line Finish area was exposed to continuous noise at an 8-hour time-weighted average sound level (TWA) of 88.0 dBA or, equivalently, a dose of 76.0 percent, during an approximate 480 minute sampling period.  d. An employee welding at the E-Line Jig area was exposed to continuous noise at an 8-hour time-weighted average sound level (TWA) of 87.9 dBA or, equivalently, a dose of 75.6 percent, during an approximate 480 minute sampling period.  e. An employee welding at the C-Line Jig area was exposed to continuous noise at an 8-hour time-weighted average sound level (TWA) of 87.8 dBA or, equivalently, a dose of 74.2 percent, during an approximate 480 minute sampling period.   f. An employee welding at the C-Line Shoes area was exposed to continuous noise at an 8-hour time-weighted average sound level (TWA) of 87.8 dBA or, equivalently, a dose of 73.9 percent, during an approximate 480 minute sampling period.  g. An employee operating the Bar Cutter machine was exposed to continuous noise at an 8-hour time-weighted average sound level (TWA) of 87.2 dBA or, equivalently, a dose of 67.9 percent, during an approximate 480 minute sampling period.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:  On or about June 14, 2016, in the facility, employees required to perform steel fabrication, including, welding and paint dip-coating operations, were exposed to the hazard of contact with metal fumes, hydrocarbons and compressed gases. The employer had not developed, implemented, and maintained at the workplace, a written hazard communication program.
